Terms and conditions of loans

Paintings in Hospitals (PiH) is a registered charity that provides original works of art on loan to hospitals and other healthcare establishments for display in their public and patient areas only. The following terms and conditions apply to all works of art loaned out by PiH and its Regional Branches through its Picture Loan Scheme.

1. Selection of Art Work

Borrowers may select work, by appointment, from their nearest PiH branch, or at special exhibitions held regionally as advertised. Borrowers are required to select a minimum of 10 pictures per loan and will not usually be permitted to hire more than 40 works in total. For GP surgeries, healthcare centres and other small community facilities there is a minimum of 5 pictures per loan.

2. Picture Rental Agreement

Borrowers are required to sign a Picture Rental Agreement agreeing to these terms and conditions in advance of each loan period. The Agreement requires the signature of the person authorising the loan on behalf of the Borrower and also of a nominated member of staff who will be responsible for the care of the pictures whilst on loan (see 7. Duty of Care below). It is essential that this form is completed and returned to PiH at the commencement of each loan period as without it the Borrower will not be covered under the terms of our insurance. In the event of a change of personnel, it is the responsibility of the Borrower to inform PiH of this change.

3. Period of Loan

Loans are issued for either 2 or 3-year terms, with the exception of special touring exhibitions which are available for shorter periods. Borrowers are encouraged to exchange their selection of pictures on renewal or at any time during the loan period. PiH reserves the right to recall any pictures that have been on loan continually to the same borrower in excess of six years (or two consecutive terms) in order to make those pictures available to others. Where PiH may find it necessary for any reason to request the return of a particular picture during the loan period, a replacement will be offered in exchange.

4. Charges (with effect from 1st June 2004)

Charges include insurance subject to terms and conditions, (see 5. Security and Insurance) and are calculated per picture per annum at the following rates:

  • 3-year Loan £30.00
  • 2-year Loan £35.00

Future changes to the rental charges will be notified in writing to all Borrowers at least four weeks ahead of their introduction. Charges for special touring exhibitions may vary. Please contact the Curator on 020 7935 0250 for details.

Charges are non-refundable and are payable in full in advance. Pictures will not be issued before payment is received.

5. Security and Insurance

5.1 Theft

Insurance cover against theft is included in the hire charges for all works on art on loan subject to the following conditions:

  • The works of art have been properly secured to the wall using mirror plates and security screws (supplied) or an alternative secure hanging system approved in advance by PiH.
  • The theft of a work of art is reported to PiH and to the Police within 24 hours of its discovery.
  • A written theft report is submitted to both PiH and the Police describing the circumstances under which the work of art was taken.

Please note that if a work/s of art cannot be located by the Borrower during a routine inspection by PiH and no theft has been reported then the Borrower will remain liable to compensate PiH for the loss of the picture unless theft can be proven. The value of the lost work will be the value listed on the Schedule of Works on Loan issued with the Loan Agreement or any updated Schedule issued subsequently to the Borrower by PiH.

5.2 All Risks Cover for High Value Works (£1,000 +)

In addition to the Theft cover described above, all works of art on loan valued by PiH at or in excess of £1,000 are covered against all risks (e.g. vandalism or accidental damage). This cover also applies if a group of pictures sustain damage or are lost as the result of a single incident (e.g. fire or flood) where their combined value is equal to or in excess of £1,000.

5.3 Damage and Vandalism

Please note that our insurance policy does not cover accidental damage or vandalism for individual works of art valued under £1,000 and the Borrower will be liable to compensate PiH for the value of the item as listed in the Loan Schedule or cost of repair at the discretion of the charity.

6. Hanging

Pictures are supplied by PiH with mirror plates and security screws ready for hanging. PiH is happy to offer advice on hanging and display of the art works but this service is not included in the rental charges. Great care must be taken in handling the pictures at all times.

Please choose the location of each picture carefully bearing in mind any possible risk of damage from passing trolleys and other equipment. Pictures must not be hung above radiators and watercolours and textile works must not be hung in direct sunlight.

Information labels about each work are provided by PiH and must be displayed adjacent to the picture. All labels, screws and information panels remain the property of PiH and must be returned with the art works at the end of the loan period.

7. Duty of Care

In addition to the authorised signatory of the Rental Agreement, the Borrower will be required to nominate a person to take responsibility for the care of the art works while on loan, including the safe return of the pictures on expiry of the loan. This person will be expected to keep an up-to-date record of the specific location of each piece of work and to provide PiH with this information on request for inspection visits carried out annually by PiH staff. Regular checks should be made to ensure that the pictures are safe and in good order. Any damage or loss to the pictures must be reported to PiH immediately.

If it is necessary to temporarily remove artworks from the wall for redecoration or building works, this must be done in liaison with the person responsible for the loan and PiH should also be informed.

8. Transportation

The cost of collection and return of pictures is not included in the rental charges and is the responsibility of the borrower. All artworks and display labels are wrapped by PiH ready for dispatch and must be suitably packed by the Borrower at the end of the loan period in advance of return. Pictures are insured whilst in transit but must not be stored overnight and must be handled with care at all times. Borrowers may use their own transport services if appropriate or those of an experienced art courier. PiH will be happy to recommend a courier and to arrange collection and delivery on behalf of the hospital if requested.

9. Termination of the Agreement

If the Borrower fails to comply at any time with the above terms and conditions, PiH reserves the right to terminate the agreement, having given the Borrower fair warning and a minimum of 14 working days to correct the situation.
